1. General Provisions
1.1. These terms and conditions of the online store (hereinafter – the “Terms”) are a legally binding document between the Buyer and the Seller (hereinafter – the “Seller”), defining the rights and obligations of both Parties.
1.2. The Seller reserves the right to change, amend, or supplement these Terms at any time. The Buyer is informed of any changes to the Terms on the online store’s website.
2. Conclusion of the Purchase-Sale Agreement
2.1. The purchase-sale agreement between the Buyer and the Seller is considered concluded when the Buyer, having familiarized themselves with these Terms, places an order for goods in the online store.
3. Seller’s Rights
3.1. In the event of significant circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability, or security of the online store or violates their obligations, the Seller has the right to restrict or suspend the Buyer’s access to the online store without notice.
4. Seller’s Obligations
4.1. The Seller undertakes to ensure access to the services of the online store under the conditions set forth in these Terms.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method chosen by the Buyer and according to the conditions specified in these Terms.
4.3. If, due to unforeseen circumstances, the Seller cannot deliver the ordered goods, the Seller has the right to terminate the purchase-sale agreement after informing the Buyer. The Seller may offer a similar product. If the Buyer refuses, the Seller is obligated to refund the paid amount within 3 business days.
4.4. If the Buyer exercises the right set forth in clause 5.2., the Seller undertakes to refund the paid amount within 5 (five) business days from the date the returned product is received.
4.5. The Seller may withhold the refund until the goods are returned to the Seller or the Buyer provides proof that the goods have been sent, whichever occurs first.
5. Buyer’s Rights
5.1. The Buyer has the right to purchase goods in the online store in accordance with these Terms.
5.2. The Buyer has the right to withdraw from the purchase-sale agreement concluded in the online store by notifying the Seller in writing no later than within 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The Buyer may exercise the right mentioned in clause 5.2 only if the item has not been damaged, its appearance has not fundamentally changed, and it has not been used.
6. Buyer’s Obligations
6.1. The Buyer must pay for the purchased goods and accept them according to the procedure established in these Terms.
6.2. If the Buyer refuses to accept the goods without a valid reason at the time of delivery, they must cover the cost of returning the goods upon the Seller’s request.
6.3. At the time of delivery, the Buyer must inspect the condition of the parcel and the item(s) with the Seller or the delivery person.
6.4. By using the online store, the Buyer confirms agreement with these purchase-sale terms and is obliged to comply with them.
7. Prices of Goods
7.1. Product prices in the online store are shown in euros, including VAT. After order confirmation, a delivery fee (if applicable) is added to the total amount.
8. Ordering and Payment
8.1. After visiting the online store, the Buyer selects desired goods and adds them to the shopping cart. After forming the cart, the Buyer enters the personal data necessary to fulfill the order: name, surname, delivery address, phone number, and any additional information important for delivery. The Buyer confirms they have read these Terms and submits the order.
8.3. Payment can be made using Swedbank, SEB, and Luminor online banking services, as well as Visa/MasterCard payment cards. Payments are accepted in euros. Payments are processed via the MakeCommerce.lt payment platform.
9. Delivery of Goods
9.1. When ordering, the Buyer must provide the exact delivery address.
9.2. The Buyer must accept the goods personally. If the Buyer cannot accept the goods but they are delivered to the specified address, the Buyer cannot make claims regarding delivery to an incorrect person.
9.3. The Seller delivers the goods according to the delivery terms stated in the product descriptions.
9.4. The characteristics of all products are indicated in the descriptions next to each product. The Seller is not responsible if the colors, shapes, or other parameters of goods differ from the real appearance due to the Buyer’s monitor settings.
9.5. If the Buyer withdraws from the purchase-sale agreement, all amounts paid by the Buyer, including delivery costs, will be refunded.
10. Return of Goods
10.1. Quality goods can be returned within 14 days from the date of receipt. Defective goods are replaced, returned, or repaired according to the Civil Code of the Republic of Lithuania.
10.2. When returning goods, the following conditions must be met:
10.2.1. The item must be in original, undamaged packaging (not applicable to defective items);
10.2.2. The item must not be damaged by the Buyer;
10.2.3. The item must be unused and retain its commercial appearance: labels intact, protective films not removed, etc. (not applicable to defective items);
10.2.4. The item must be returned in the same set as received (not applicable to defective items);
10.2.5. The Seller has the right to refuse returns that do not meet these conditions;
10.2.6. Goods must be returned in the manner specified by the Seller within 14 (fourteen) days from receipt (does not apply to defective goods – these may be returned within the statutory warranty period).
10.3. Return and exchange of quality goods are carried out according to Article 6.22810 Part 1 of the Civil Code.
10.4. Money for accepted but later returned goods must be refunded to the Buyer’s account within 5 (five) days from the date the goods are returned, unless otherwise agreed.
11. Final Provisions
11.1. These Terms are drawn up in accordance with the laws of the Republic of Lithuania.
11.2. These Terms and the relations between the Parties in connection to these Terms shall be governed and interpreted according to the laws of the Republic of Lithuania.
11.3. All disputes arising from the implementation of these Terms shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the laws of the Republic of Lithuania.
11.4. The Parties are released from fulfilling obligations under these Terms if such obligations cannot be fulfilled due to unforeseen circumstances beyond the control of the Parties (Force Majeure).
